 DEFINITIONS.

Businesswomannatural or legal person contracting the products offered for a purpose related to his trade, business, craft or profession; Usernatural person who contracts the goods for a purpose which is outside his trade, business, craft or profession; GCCGeneral Terms and Conditions; Contracting Person: user or entrepreneur who contracts the products offered.

1. IDENTIFICATION OF THE PARTIES.

2. ACCEPTANCE AND MODIFICATION.

The user declares that he/she has legal capacity*. to contract and accepts full and unreserved adherence to the General Terms and Conditions, hereinafter referred to as GTC, in the version published at the time of contracting.

The sales concluded are distance sales regulated by the Spanish legislation in force on the matter.

We also inform you that these GTC may be modified. The user is responsible for consulting them each time he/she accesses, browses and/or uses the Website, as those in force at the time the purchase of products is requested will be applicable.

• Send the user the proof of payment or invoice for the products contracted.
• Comply with the provisions of the regulations on the rights of consumers and users.
  • Obligations of the Employer:
• To fully comply with the provisions of the GTC.
• Complete the registration forms prior to the start of the contracting procedure with truthful and current information in order to access any of the products offered on the Website. Likewise, the user guarantees and shall be responsible for keeping them completely updated for as long as he/she remains a user of the Website.
• Complete the product access forms with accurate and current information, as this data is necessary for the issue, where appropriate, of the invoice for the products. PEPE LA SAL SHOP and the collection of the contracted products.

4. CONTRACTUAL IMPROVEMENT.

All products offered in PEPE LA SAL SHOP are subject to availability. In the event that we are unable to supply a product, either due to a lack of stock or due to a delay in the updating of a product ordered, PEPE LA SAL SHOP shall contact the user to inform him/her of such an event within the shortest possible period of time. In such a case, the user will be informed and may purchase alternative products, or will be offered an alternative delivery time for the product originally ordered.

If this period is not satisfactory, or if it is not possible to supply the product ordered, the user may cancel the Product order free of charge, proceeding to the immediate reimbursement of the amount paid and thereby ending any liability of PEPE LA SAL SHOP in front of the user.

Published prices are in euros and include VAT, equivalent taxes and shipping costs. The user will be able to know the total amount before contracting the products.

8. TRANSFER OF RISK AND OWNERSHIP.

The Contracting Person acquires ownership of the products upon full payment of all amounts, including shipping costs.

The risk of loss or damage shall be transferred to the Person Employerwhere he or a third party, other than the carrier and indicated by him, has acquired its material possession. If it is the Person Employer the party ordering the transport or the carrier chosen was not among those proposed by PEPE LA SAL SHOPthe risk shall be transferred to the Contracting Person with the delivery of the goods to the carrier.

9. SHIPPING POLICY.

In any case PEPE LA SAL SHOP shall deliver the products to the Contracting Person within 30 calendar days of the conclusion of the contract.

Once the contract has been concluded, the person Employer you will receive a purchase confirmation e-mail and a delivery confirmation e-mail once the order has been handed over to the carrier.

Home delivery is from Monday to Saturday, except on public holidays.

Those orders in which the radius of dispatch is less than 22 km, orders placed before 09:00 are delivered during the same day until 15:30, orders placed after 09:00 are delivered the following day.

The shipping costs are:

• 3 €, with a radius of 5 km.
• 5 €, with a radius of 5 to 10 km
• 7 €, with a radius of 10 to 22 km.

When the shipping radius is less than 22 km and the total amount of the order is more than 120 €, the shipping costs will be free of charge.

10. SPECIFIC PROVISIONS FOR THE USER.

• Right of withdrawal.

The user has at his disposal a time limit of 14 calendar days without the need for justification. The withdrawal period shall expire 14 calendar days after the day on which the user or a third person indicated by the user, other than the carrier, acquires the material possession of the goods/.

Consequences of withdrawal:

In the event of withdrawal by you, we shall refund to you all payments received from the user, including the costs of delivery (with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, I will not incur any costs as a result of the reimbursement. The reimbursement will be withheld until we have received the goods or until the user has provided proof of the return of the goods.

The right of withdrawal does not apply to the following products:

  • Legal Guarantee.

All products sold from 1 January 2022 onwards are covered by a three-year legal guarantee against non-conformity, in accordance with the provisions of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users.

The user has a period of time of three-year warranty from the delivery of the product. Defects caused by negligence, knocks, improper use or manipulation by the user are not included in this guarantee. In the absence of proof to the contrary, it shall be presumed that any lack of conformity that becomes apparent within six months of delivery of the product already existed when the product was delivered.

The legal guarantee comprises the following rights for the User:

All costs incurred in the exercise of this right shall be free of charge for the User.
• The price reductionand the termination of the contract shall proceed, at the User's choice, when the User is unable to demand repair or replacement and in cases where these have not been carried out within a reasonable period of time or without major inconvenience to the User. The termination will not proceed when the lack of conformity is of minor importance.

The images associated with the products offered are merely illustrative and may not be a true reflection of the product, as manufacturers and distributors are constantly renewing them.

11. SPECIFIC PROVISIONS FOR THE EMPLOYER.
    • Invoicing and Delivery.

PEPE LA SAL SHOP deliver the invoice by e-mail to the Employer before the due date. 30 days from the date of delivery.

All notifications made in accordance with the above procedure shall be deemed to have been validly made.

13. ONLINE DISPUTE RESOLUTION.

If any of these GTC are declared null and void by a final decision issued by a competent authority, the rest of the clauses shall remain in force, without being affected by such declaration of nullity.

15. LANGUAGE

The language in which the contract is formalised is Spanish.

16. COMPETENT JURISDICTION.

In the event of a dispute between the parties, the territorial jurisdiction shall be, at the user's choice, the domicile of the user or of the defendant.

In the event that you are contracting with an employer, in the event of a dispute, the territorial jurisdiction will correspond to the courts of Denia.
